1. Acceptance of Terms

The Aygar Digital name, logo, and all related product and service names, design marks, and slogans are trademarks of Aygar Digital LLC. You may not use these marks without our prior written permission. All other trademarks referenced on this Site are the property of their respective owners.

Case studies and client work showcased on this Site reflect engagements where Aygar Digital performed services. Client names and logos are used with permission or under standard industry practice for portfolio display and remain the intellectual property of their respective owners.

4. User Submissions & Contact Forms

When you submit information through our contact form, you represent that:

• The information you provide is accurate and complete
• You are submitting a genuine business inquiry related to our services
• You are not submitting unsolicited sales pitches, marketing offers, or recruitment solicitations

By submitting a contact form, you grant Aygar Digital permission to use the submitted information to respond to your inquiry and, where relevant, to prepare a project proposal. We do not use submitted information for any other purpose. See our Privacy Policy for full details.

Any feedback, suggestions, ideas, or other information you voluntarily provide to Aygar Digital becomes our property. We may use such submissions for any purpose, including improving our services, without obligation or compensation to you.

5. Disclaimers & No Warranties

The Site and all information, content, materials, products, and services available on or through the Site are provided on an "as is" and "as available" basis without representations or warranties of any kind, either express or implied.

To the fullest extent permitted by applicable law, Aygar Digital expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement

Case study results and metrics presented on this Site represent outcomes achieved for specific clients under specific circumstances and are not guarantees of future results. Individual results will vary based on the nature of each engagement, client industry, budget, and other factors outside our control.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Aygar Digital LLC, its officers, directors, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising from:

• Any content obtained from the Site
• Unauthorized access to or alteration of your transmissions or data
• Any third-party conduct or content on the Site

In no event shall Aygar Digital's total liability to you for all claims arising out of or relating to your use of the Site exceed one hundred U.S. dollars ($100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Aygar Digital LLC and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Site, including but not limited to any content you submit through the contact form
• Your violation of any rights of a third party, including intellectual property rights
• Any claim that information you submitted caused damage to a third party

9. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Cook County, Illinois, and you irrevocably consent to the personal jurisdiction of such courts.

Before initiating formal legal proceedings, we encourage you to contact us at support@aygar.com to attempt to resolve any dispute informally. We will make reasonable efforts to address your concerns within 15 business days.

10. Accessibility Commitment

As a digital experience studio that specializes in UX and product design, we hold ourselves to a high standard of accessibility. Our ongoing efforts include:

• Semantic HTML — using proper heading hierarchy, landmark regions, and meaningful markup so screen readers can interpret content correctly
• Keyboard navigation — ensuring all interactive elements (links, buttons, form fields) are fully operable without a mouse
• Alternative text — providing descriptive alt attributes on all meaningful images so users of assistive technology receive equivalent information
• Color contrast — maintaining sufficient contrast ratios between text and background colors to meet WCAG 2.1 AA minimums
• Responsive design — the Site is designed mobile-first and adapts to all screen sizes and zoom levels without loss of content or functionality
• Form accessibility — all form fields are properly labeled, required fields are identified, and error messages are descriptive and programmatically associated with the relevant input
• ARIA attributes — ARIA roles and attributes are used where necessary to enhance the experience for assistive technology users
• Focus management — visible focus indicators are maintained so keyboard users can always identify which element is active

Known limitations & disclaimer: While we actively work toward full WCAG 2.1 AA conformance, we acknowledge that certain elements of this Site may not be fully accessible to all users. Specifically:

• Animations & motion effects — This Site uses CSS animations, parallax scrolling effects, auto-rotating orbit visualizations, and other motion-based elements for aesthetic purposes. These may present challenges for users with vestibular disorders, epilepsy, or motion sensitivity. Users who have enabled the "Reduce Motion" preference in their operating system or browser may experience reduced or disabled animations where supported, but we cannot guarantee all animated elements respond to this preference at this time.
• Complex visual components — Some interactive visualizations (such as animated orbital diagrams and scrolling galleries) are primarily visual in nature and may not convey the same information to users relying solely on screen readers. We strive to provide equivalent text-based context where possible.
• Images & media — While we provide descriptive alt text for meaningful images, some decorative or background images may have limited or no text alternatives. Portfolio and case study imagery is supplemented by descriptive captions where feasible.
• Third-party components — Tools including Google reCAPTCHA, Google Analytics, and embedded fonts are provided by third parties and may have accessibility limitations outside our direct control. We work to mitigate these where possible but cannot guarantee full conformance for third-party code.
• Auto-playing content — Certain page sections may include auto-playing animations or looping visual effects that cannot currently be paused or stopped by the user directly. We are actively working to add user controls for these elements.

We do not warrant that this Site is fully compliant with any specific accessibility standard. Our goal is continuous improvement, and we treat every accessibility report as a priority.
